MEET Daniel D. Barks
Esq.This year is Dan Barks’ 30th year in the practice of law. During the last three decades as a litigator he has focused almost exclusively on aviation law. Acting as lead counsel in cases filed across the United States, he has developed a reputation as an attorney who does not hesitate to take a case to trial. His expertise and detailed knowledge of aircraft systems, aerodynamics, and pilot performance from his time served as a Naval Aviator (pilot) in the US Navy provides an advantage few attorneys possess.
Biography
Born in the Southeastern United States, Mr. Barks grew up on the college preparatory campus of the Baylor School in Chattanooga, Tennessee where his father served as President for 20 years and his grandfather, for 40. Upon graduation from High School, he attended the University of Tennessee where he was awarded a Bachelor of Science in Political Science with a concentration in Middle Eastern studies.
Following graduation from university, he joined the United States Navy, serving on active duty from 1985 until 1991. Designated a Naval Aviator (pilot) in 1986, then Lieutenant Barks, flew the A-6E Intruder Attack Aircraft. He continued with the Navy Reserves for over a decade.
Mr. Barks served the Navy in Desert Shield and Desert Storm. Upon returning from the Middle East, he left active duty to pursue a legal degree.
Mr. Barks continued flying after his active-duty Navy career, and he maintains his licenses and certifications as a pilot to this day.
Mr. Barks entered law school at the University of South Carolina, (USC) and was awarded a Juris Doctorate, with honors, in 1996. During his time at USC, he focused his studies on products liability under Professor David G. Owen, (of Prosser Keeton & Owen on Torts). Mr. Barks has continued to write and lecture on the commercial and ethical implications of Products Liability laws and the effects of Tort Reform on the progress of product safety and the economy.
Mr. Barks started practicing as a trial attorney in 1996. Since that time he has gone on to lead and manage over 50 litigations in the United States and abroad. While focusing primarily on aviation litigation, he has also litigated in the areas of the Federal Tort Claims Act, both in the areas of Air Traffic Control negligence, and as a co-lead counsel in the recent matter of the Sutherland Springs Mass Shooting, in Texas. In addition, Mr. Barks has litigated in the areas of general products liability, general negligence, and intentional torts both in wrongful death and catastrophic personal injury. He has also successfully tried breach of contract cases and tortious interference with contract cases to successful verdicts in various jurisdictions.
He has been admitted to and argued appellate matters in the 11th Circuit Court of Appeals, the Supreme Court of Virginia, and the Supreme Court of Louisianna.
Mr. Barks is currently licensed to practice law in the US in Georgia, Virginia, and New York, and is admitted to numerous appellate courts and the Supreme Court of the United States. He is the past Chair of the American Bar Association, Torts Insurance Practice Section for Aviation and Space, and speaks frequently on issues of aviation law and trial practice.
