Auto Repair Shop Pays $1 Million Dollars in Tire Placement Case

A $1,000,000.00 settlement was successfully negotiated in the wrongful death and negligence lawsuits brought by Texas attorneys Rob Ammons and Justin Burrow against an auto repair shop. The litigation stemmed from a crash in which a 2003 Ford Explorer XLT suffered a tread separation of its right rear tire, causing the vehicle to enter the median and rollover.tire-placement-case

The repair shop serviced the Explorer prior to the rollover crash and installed two new tires on the front axle of the vehicle. The repair shop failed to place the tires with the best rubber and deepest remaining tread depth on the rear axle.

It has been known since the 1970s that it is safest to have one’s least worn tires on the rear axle. The Ammons Law Firm alleged that the auto shop should have positioned the newest, best tires on the vehicle’s rear axle to provide the safest handling – something the auto shop was aware of but failed to do in this case – and therefore, were negligent and contributed to the crash in question.
