FACTS & ALLEGATIONS:
Magaly Doe, 24, was a front seat passenger in a 2002 Ford Explorer SUV when the vehicle rolled over on a dry flat highway. During the rollover, the vehicle’s roof crushed in, and the side window shattered. Doe, who was wearing her seat belt, was partially ejected through the window opening and suffered fatal head and spinal injuries.
Doe’s parents, individually and on behalf of their daughter’s estate, sued Ford Motor Co., alleging it was defectively designed in that it had a narrow track width and a high center of gravity, making it prone to roll over during foreseeable maneuvers.
