FACTS & ALLEGATIONS:

When a 2001 Jeep Cherokee Sport driven by Max Doe collided with a vehicle on a bridge, the Jeep struck the bridge guardrail.  The front seat occupants of the Jeep, Doe and Richard Smith, were propelled rearward by the impact, causing the rear-seat occupants, their respective spouses Leah and Frances, to be ejected through the lifegate window.

Frances, 67, drowned after landing in the water below.  Leah, 67 sustained numerous blunt force injuries to her head and torso, including facial fractures, a diffuse brain injury, a T-5 fracture and lung contusions.  Doe, 68 sustained traumatic and avulsion injuries to his right hand.

Max  Doe and Richard Smith, individually and behalf of their wives sued the car manufacturer.  They alleged the Jeep Cherokee’s steering system was defective in that its seats were not strong enough to withstand the impact of the collision. Additionally, they alleged the manufacturer should not have used tempered glass in the liftgate and side-passenger windows.
