FACTS & ALLEGATIONS:
Edward D., age 48, was the front passenger in a pickup traveling on an interstate highway in Louisiana when the BF Goodrich Long Trail tire positioned at the left rear of the vehicle peeled apart. The tire disablement caused the pickup to skid across the travel lanes, hit a guardrail and roll over. Mr. D sued Michelin, who manufactured the tire, alleging that the tire was built with porous materials, improperly placed belts, and inadequate bonding between the belt layers. It was also alleged that the tire was designed without a full nylon cap ply known to provide resistance to tread/belt separation.
INJURIES & DAMAGES:
Edward D. suffered C5-C6 subluxation with fractures of the C5 pedicle and C5 facet, and severe spinal cord injury, rendering Edward D. permanently quadriplegic.
RESULT: A confidential settlement was reached.
