A Florida man sustained fatal injuries when the catastrophic separation of tread from the carcass of its left rear tire caused his van to leave the highway and rollover.
The tire was a BFGoodrich Radial T/A tire designed and manufactured by Michelin North America, Inc. At the time it was placed on the van by a local tire shop, the tire was over ten years old and had deteriorated because of age.
In the lawsuit brought on behalf of the wife, children and parents the man left behind, Rob Ammons claims the Radial T/A tire was manufactured by Michelin using inadequate materials and processes and that it was designed without the features necessary to prevent a tread/belt separation. Ammons also claims Michelin knew of the adverse effects aging has on the integrity of a tire’s components but that it did nothing to warn consumers that older tires are dangerous.
The tire shop was included in the lawsuit because the old, deteriorated tire should not have been sold and placed into service on the van. Ammons points out that tires degrade over time, whether or not they are being used, and tire of advanced age are simply not fit for use.
According to Ammons, “Old tires are failing and causing countless accidents on our roadways. Refusal of companies like Michelin to issue appropriate consumer warnings about tire aging and to instruct sellers to remove their tires from their inventory when they are of a certain age is unacceptable.”
