Passive Seat Belt To Blame For Paralyzing Injuries

FACTS & ALLEGATIONS:

Jeanie Doe was a passenger in a 1991 Honda Accord when it was involved in a foreseeable collision. During the incident, the passive seat belt system did not properly restrain her. Doe sued Honda, alleging that the seat belt system was defective. Its design included a motorized torso belt and a manual lap belt. To the extent that the two-point shoulder belt is frequently used by occupants without the lap belt protection, the design permits users to unknowingly utilize the system in a less than optimal manner.

INJURIES & DAMAGES:

Doe sustained a T5 fracture-dislocation that resulted in paraplegia. She also sustained chest trauma, rib fractures, hemothorax and pulmonary contusions, as well as fractures of the distal right radius and ulna.

RESULT: Doe obtained a confidential settlement.
