Ammons Law Firm Files Lawsuit Against Insurance Carrier for Failing to Pay Coronavirus-Related Claims

The Ammons Law Firm has filed one of the country’s first lawsuits against an insurance company for business losses caused by the coronavirus and government orders that prevent companies from doing business.

A number of executive orders from Texas Governor Greg Abbott, as well as orders from local government, have closed non-essential business and ordered people to shelter in place.

One of Governor Abbott’s orders even postpones surgical or medical procedures unless they are immediately necessary to correct a serious medical condition or to save the life of a patient. The Governor’s order follows Centers for Disease Control and Prevention guidelines that recommend postponing elective-provider visits and elective or non-urgent admissions, surgeries, or medical procedures.

Commercial insurance policies often cover the losses a company suffers when business is interrupted by physical damage or loss or the business is closed by a government order. However, insurance companies and their agents are currently disputing whether business losses caused by COVID-19 or mandatory business closures are covered under these policies.
