PULASKI COUNTY, Ark.—Two people died on March 23 in a terrible crash on Interstate 430, just north of Colonel Glenn Road in Little Rock.
Authorities identified one of the victims as Fabiana Garcia, a 31-year-old Little Rock resident.
Garcia and the other victim were reportedly traveling in a 2010 Dodge Avenger on northbound I-430 when a tire on the vehicle blew out at about 1 p.m., causing the vehicle to leave the roadway and hit a tree. Both occupants are believed to have died on impact.
An investigation into the accident is ongoing. State police have not released any additional information.
Commentary on the fatal accident caused by tire blowout that claimed multiple lives
Accidents caused by a sudden loss of tire pressure are often deadly. The report here is eerily similar to numerous other tire defect accidents my firm has handled over the last thirty years. Ms. Garcia was driving northbound on I-430, presumably at highway speeds, when her vehicle experienced a sudden and unexpected loss of tire pressure. As a result, Ms. Garcia lost control of the vehicle and crashed into a tree, killing her and a fellow passenger.
Anyone reading this account, and especially the deceased victims’ families, know this accident would not have occurred had the tire not failed. When an accident is caused by something other than driver error, the law deems the party that caused the accident at fault and holds that party accountable for all losses stemming from their actions. That means if the loss of tire pressure experienced here was a result of the tire manufactures actions––a poorly designed tire or tire without proper warnings—the tire manufacturer would be liable for all the losses sustained because of this accident.
For people that have not had a loved one ripped from their care unexpectedly, it is difficult to understand the degree of pain and suffering caused by such an event. The law has provided family members of a deceased victim the right to recover from the pain they experience, the support they will go without, and the guidance the deceased would have provided had their life not been cut short.
For the families here, it is imperative that an investigation is undertaken as soon as possible to ensure the details surrounding the tire and the accident are preserved and a determination is made concerning the tire’s cause of failure. This process is a routine part of the post-accident process and is conducted by trained professionals. My firm has assisted clients across the nation in this very scenario and have ensured justice for countless victims affected by tire failure accidents.
I hope the families here can receive the help they need and the justice they deserve. Until then, I pray these families may have peace during this difficult time of loss.
