Accidents like this happen in a split second, and our deepest condolences go out to Ms. Smith’s loved ones. The investigation is ongoing, but our firm has ample experience representing victims of auto-pedestrian accidents. The first issue that needs to be addressed is whether Ms. Smith was in the travel lane at the time of the crash. If she wasn’t, then the truck driver is clearly responsible for this crash, and Ms. Smith’s family needs answers.
However, even if Ms. Smith was in the travel lane, the driver is not immediately excused of all liability. All motorists have a duty to remain vigilant while operating a motor vehicle. Failure to stay alert and attentive is negligent and may result in responsibility depending on the facts and circumstances of the incident.
Unfortunately, one of the most common causes of auto-pedestrian crashes is distraction. Whether it is improper use of a cell phone or snacking while driving, our firm repeatedly handles cases where a distracted driver hits our client. When this happens, the driver is often devastated by their action but believes the pedestrian is at fault. There is no excuse for distracted driving. Unfortunately, most drivers do not learn the serious risks associated with this behavior until after they are involved in a serious accident.
This is a difficult time, and our firm extends our deepest condolences to the Smith family.
