Commentary on tractor-trailer rollover collision in Albuquerque
From what we know about the conditions of this collision, it is remarkable that no fatalities resulted. We pray the victim’s injuries are minor and wish them a speedy recovery. We do not know much for sure at this time. Still, our firm is experienced at conducting investigations into accidents just like this, and there are a few common causes that stand out as likely explanations. Any one of these possible scenarios would provide the injured parties an opportunity to recover the compensation they need to cover out-of-pocket expenses and provide relief for the harm caused by their injuries
When a tractor-trailer collision ends in a rollover, it is often found that the cargo was not loaded properly. There are specific rules and regulations concerning the allowable weight for tractor-trailers, as well as proper practices for how the cargo is stored within the trailer. Unfortunately, we find that these safety guidelines are often neglected by shipping companies in the name of efficiency, putting their own employees and other drivers at risk. We do not know which driver was injured in this crash, but if an investigation reveals that improperly loaded cargo was the cause of the rollover, it will present an opportunity for either driver to recover against the shipping company.
Bad steer axles or steer axle tires are another regrettably common cause of accidents that our firm deals with on a regular basis. Steer axles and tires that are in working order are essential to allow tractor-trailers to navigate roadways safely. Unfortunately, our investigations often find that proper maintenance is often neglected, causing the driver to lose control and crash into fellow motorists. Evidence that the steer axles on the truck involved in this accident were not adequately maintained would allow us to form an aggressive strategy to pursue relief from the truck’s manufacturer or maintenance company.
Alternatively, this may be a simple case of negligence on part of one or both drivers. While this is the most straightforward and common scenario, such a finding will still need to be properly investigated to determine if the fault extends beyond the driver. For commercial drivers specifically, the employer must provide proper training to ensure safe driving practices are adhered to. Failure to do so may result in liability to both the truck driver and the trucking company.
