Brief thoughts on fatal two-car crash in Orange County
Unfortunately, this is exactly the type of tragedy that our firm helps victims and their loved ones navigate every day. The lives of everyone involved changed in an instant, and no one should have to deal with the aftermath alone. Our firm has the expertise needed to help families get answers and relief, quickly. While we would need to conduct an investigation to identify any definitive causes, the facts here allow us to begin formulating some potential legal strategies.
Increasingly, the cause of head-on passenger vehicle crashes like this is found to be distracted driving. Smartphones are an ever-present piece of technology we all rely upon, and unfortunately, some individuals make the mistake of thinking they can use their phones while operating a vehicle. However, no matter how good of a driver one thinks they may be, phones take our attention from the road, and even a split-second lapse in judgment can lead to catastrophic results. This is precisely why all states have enacted laws aimed at preventing phone use. A finding of this nature may allow the victim’s family to recover from the distracted driver’s insurance provider for negligence.
Another possible cause of this crash that will need to be investigated is the condition of the vehicles themselves. While rarer than distracted driving, our firm handles cases like this every day that were caused by a defective product. We don’t know anything about the condition of the road on which the crash occurred, or anything about the environmental conditions at the time of the crash, but issues with braking systems, steering mechanisms, and tires are all common reasons why drivers lose control of their vehicle and ultimately cause an accident. A defect in either vehicle may provide a basis to recover against the manufacturer of one or both of the vehicles. In an accident such as this one, where two people lost their lives, this possibility will allow both families to recover against the manufacturer.
the repair shop or the manufacturer’s failure to meet their duty to their customers.
