Anthony Smith died in a car crash with a parked truck on Hwy 45 near Marion


MARION, Mississippi—Anthony Charles Smith, 55, of Bolton, Mississippi, passed away in a car crash on Highway 45 North on October 3, 2022. Smith was a passenger in the wreck, which occurred around 7:30 a.m. Two other individuals involved in the crash were also injured.

Police reports suggest the gray Acura in which Smith was riding was headed northbound on Highway 45 when it rear-ended a log truck parked on the side of the road.

Smith died in the crash. Although two people were taken to a local hospital, the conditions of all others involved have not been released.

An investigation is ongoing into the cause of this accident. No other details have been made publicly available.

Parked trucks are rear-ended on a seemingly daily basis and routinely result in preventable death

The serious risk posed by large trucks parked on the shoulder of the road cannot be overstated. We are presented with accidents just like this one on a repeated basis, and they almost always result in a fatality. Such accidents cannot be entirely the driver’s fault when the truck driver should know the risk they are creating by parking on the road’s shoulder. Something must be done to prevent these accidents from continuing and innocent lives being cut short. One way to accomplish this is by holding the company responsible. At the end of the day, holding a company financially responsible motivates the company to implement safety rules and procedures to prevent future accidents.

Commercial truck drivers, including drivers for logging companies, must abide by federal rules and regulations, which prohibit parking on the shoulder of major highways except for in emergencies and when the truck driver warns other drivers of the hazard by immediately turning on warning lights and setting out traffic cones around the truck.

Here, it is unclear whether the truck driver was following federal law and whether the driver had provided other drivers with adequate warning of the hazardous truck. Apart from being the sole responsibility of the truck driver, commercial trucking companies are often responsible for the actions of their employees. Companies with hired drivers should educate their drivers on safety procedures following a breakdown or accident. So, if the log truck driver was forced to park on the shoulder, the driver should have had the training and resources to handle the situation appropriately.

This is a terrible wreck that will cause severe pain in many people’s lives. If the actions of the company or driver could have prevented the risk created by parking on the shoulder, such actions should be revealed and accounted for.
