Lawyer Files Suit Against Ford in Nevada After Client Dies in F-250 Truck Rollover Accident


HOUSTON, Texas — The Ammons Law Firm has filed a lawsuit against the Ford Motor Company on behalf of the family of a Nevada man who suffered fatal injuries when his F-250 pick-up truck rolled over and crushed the truck’s roof into the man’s survival space.

Filed in the Nevada Division of the U.S. District Court, the suit alleges Ford failed to make the truck’s roof strong enough to support the vehicle’s weight in rollovers, causing the vehicle’s occupant to suffer fatal injuries. The lawsuit further alleges that the decedent would have walked away from the crash if the F-250 had been equipped with a roof structure strong enough to maintain its integrity throughout the rollover sequence. The lawsuit claims that Ford failed to test the F-250’s injury prevention and occupant protection capabilities through dynamic rollover testing, which would have provided actionable data on the truck’s roof structure under real-world conditions. The lawsuit alleges that the technology required to prevent severe and often fatal injuries during a rollover accident was available to Ford when the truck was designed and manufactured.

Each year, more than 280,000 rollover crashes are reported in the United States, resulting in the deaths of more than 10,000 people, according to the National Highway Traffic Safety Administration. Although this represents less than 3 percent of all passenger vehicle accidents, they are the biggest killers in light trucks and SUVs and account for almost 35 percent of all highway fatalities, according to the Insurance Institute for Highway Safety (IIHS). Rollover injuries can result from a roof crushing into the occupant’s survival space, leading to an occupant’s “second” collision with structures and components within the vehicle.

“The collapse of the truck’s roof due to negligent manufacturing and testing has left a man dead, and Ford was entirely capable of preventing this outcome by designing the truck with a roof structure that supported the weight of the vehicle,” said attorney Rob Ammons, founder and managing partner of The Ammons Law Firm.
