Lawyer files a lawsuit against Michaels on behalf of a customer injured by falling merchandise


MIDLAND, Texas – The Ammons Law Firm has filed a lawsuit against Michaels Stores, Inc., on behalf of a customer who was severely injured when she was struck by a falling object. The firm also represents the injured victim’s husband for loss of consortium.

The accident occurred when the victim was shopping at a Michaels store in Midland, Texas. As she was browsing, an item fell from the top shelf, striking the victim on the head. The victim suffered severe injuries resulting from the accident. Her injuries have impacted her ability to complete everyday tasks and have also impacted her association and companionship with her husband.

The lawsuit filed in the 134th Judicial Circuit of Dallas County, Texas, alleges that Michaels was negligent in its duty to the victim by failing to properly store and display its products. The suit alleges that Michaels stored a product on a top shelf without taking proper precautions to ensure that it did not fall. Such precautions would have included installing a front shelf divider to restrain the product and ensuring the product was sloped backward to stabilize the product. The suit further alleges that Michaels failed to follow its own regulations regarding overstock inventory by storing the product vertically in an unsafe position and failing to store the product in a plastic storage container.

Finally, the suit claims that Michaels’s actions reached the level of gross negligence. Michaels, Ammons alleges, should have known that its storage of the product on a top shelf presented an extreme degree of danger to its customers.

Stores have a duty to their customers to provide a reasonably safe premises. In this case, Michaels failed to provide a safe premises and failed to warn the victim of the potential dangers posed by the unsafe premises, resulting in severe injuries to the victim.
