Diana Robles, Ofelia Figueroa-Perez, and Don Fehd killed after vehicle drifts off the edge of Camp Bird Road near Ouray

OURAY, Colorado—Diana Robles, 28, her aunt, Ofelia Figueroa-Perez, 60, and Jeep tour driver Don Fehd all passed away tragically on September 12, 2022, after a rollover accident near the Yankee Boy Basin in Colorado.

According to reports, the two female passengers and the Jeep tour driver were returning from Yankee Boy Basin headed toward Ouray when their vehicle, a 2022 Jeep Gladiator, drifted off the road and rolled multiple times to the bottom of a steep bank.

Fehd was thrown from the Jeep and was found deceased near the banks of Canyon Creek. Robles and Figueroa-Perez passed away in the vehicle as a result of injuries sustained in the crash.

The cause of the accident is unknown, and the investigation is still ongoing. There were no other details about the crash immediately available.

The family of Robles and Figueroa-Perez will be able to bring a claim against the driver and possibly the company for this horrific accident

It is extremely saddening to learn of the deaths of a young woman and her aunt while enjoying a tour in the beautiful state of Colorado, and it is equally disheartening to know the tour driver was flung from the vehicle before he died. While the Jeep tour driver was likely negligent in driving on Camp Bird Road, the tour company will likely share responsibility for the untimely deaths of the two women passengers under the legal doctrine of respondeat superior.

Respondeat superior stands for the principle that an employer can be held legally responsible for the wrongful or negligent acts of an employee when such negligence occurs within the scope of employment. Although it may be true that the Jeep driver ran off the road accidentally, it seems more likely that the driver was distracted or even fatigued, which ultimately led to this unfortunate wreck. To determine whether that is the case, an independent investigation will need to be requested by the family of Robles and Figueroa-Perez.

Should an investigation reveal that the tour driver was, in fact, negligent while driving the women toward Yankee Boy Basin, then the family should bring a direct claim against the tour truck company for failing to ensure its driver was able to perform his job duties safely.
