Joseph Pohlmeier was severely injured in an accident with a semi-truck while riding a motorcycle on Webster Boulevard

CASS COUNTY, Nebraska—Joseph Pohlmeier, 56, was airlifted to a local hospital for treatment of serious injuries after his motorcycle crashed into the side of a semi-truck around 10:00 a.m. on September 20, 2022, near Highway 75 and Webster Boulevard.

According to authorities, both the semi-truck and Pohlmeier were traveling in opposite directions on Webster Boulevard when the semi-truck attempted to turn onto 1st Avenue. Reportedly, the semi-truck driver did not see any oncoming vehicles when he went to make the turn, but Pohlmeier crashed into the side of the truck as it was turning.

The condition of Pohlmeier remains unknown, and the investigation into this accident is ongoing. No further details about the wreck have been released.

People should be compensated for the pain and suffering they must endure because someone else’s mistakes

Even with the limited facts surrounding this accident, it appears as though the semi-truck driver failed to see Pohlmeier on his motorcycle, which can be characterized as negligence. However, an independent investigation will reveal with more certainty whether the semi-truck driver’s negligence was the cause of this accident.

The goal of a personal injury lawsuit is to help an injured person receive the financial compensation they need to put their life back together. Serious injuries such as the ones suffered in this accident cause long-term problems that require money. It is not fair for Mr. Pohlmeier to have to suffer the injuries and pay the costs. As such, it is important to determine all parties responsible for the accident to ensure Mr. Pohlmeier and his family receive every dime of compensation they need to rebuild their lives.

Semi-truck drivers must be vigilant while driving and observe all traffic laws. Yielding to oncoming traffic before turning is a basic traffic rule of which all drivers should be aware. However, if the semi-truck driver failed to see Pohlmeier on his motorcycle before turning, then perhaps the truck driver was not educated on where to look for smaller vehicles and motorcycles. Semi-trucks, like all passenger cars, have blind spots where drivers may be unable to see motorists in mirrors. Blind spots on semi-trucks are much larger, simply due to the size of the vehicle. Therefore, semi-truck drivers should be taught how to look for other cars, motorcycles, and bicycles in blind spots before switching lanes or turning.

If the semi-truck driver in this accident was not educated about blind spots and how to avoid collisions, then Pohlmeier may have a direct claim against the trucking company that employed the driver since companies are ultimately responsible for training their employees on the necessary precautions to take in performing job duties.

Additionally, an independent investigation may reveal whether the semi-truck at issue was equipped with underguards along the sides of the trailer to decrease the severity of any potential crash. Underguards protect other drivers from going underneath the side of a tractor-trailer in an accident. Here, the fact that Pohlmeier crashed into the side of the semi-truck raises concerns about whether his injuries could have been lessened by the presence of underguards.

There are many potential parties that could be responsible for this crash and the resulting injuries, and without an independent investigation, we really can’t say one way or the other. However, a man was seriously injured and will likely be dealing with unexpected challenges for the rest of his life. If any other party is responsible for such harm, they need to be identified and held accountable.
