Kenneth Key was killed after his parked vehicle was hit by a passing truck near Augusta

AUGUSTA, Georgia—Kenneth Allen Key, 55, passed away on September 19, 2022, after his car was struck by a tanker truck hauling fuel on Peach Orchard Road.

Police reports state that the tanker truck was traveling southbound on Peach Orchard Road when it hit Key’s car, which was parked on the side of the road at the time of the accident. The tanker truck then rolled over and spilled its contents onto the roadway.

The crash prompted authorities to reduce southbound traffic on Peach Orchard Road to one lane for more than 24 hours. The condition of the tanker truck driver is unknown at this time.

Investigation into the cause of the accident is ongoing. No other details about the crash have been released.

Failing to avoid a parked vehicle is unacceptable, and the family deserves answers

While we cannot make any firm conclusions until further information has been obtained, this accident appears to be caused by poor decision-making on the part of the truck driver. Crashing into a car parked on the shoulder of the interstate is not only avoidable but is entirely unacceptable. Consequently, the family of the deceased will likely be able to bring a claim against the driver and, possibly, the trucking company that employed the driver.

Semi-truck drivers must constantly be aware of their surroundings and on the lookout for potential hazards on and around the roadway. Because semi-trucks are so large and require more time to stop and more space to avoid an accident, it is imperative that truck drivers understand the importance of detecting hazards well in advance. Here, the semi-truck driver should have seen the parked car on the shoulder of the interstate and made appropriate adjustments in the truck’s course to avoid colliding with the car. Instead, the truck driver crashed into the car, leaving an innocent man dead.

Additionally, commercial trucking companies must also do their part to minimize the risks of accidents on our nation’s busiest roadways. As such, trucking companies should seek to hire qualified drivers with excellent driving records and provide regular educational opportunities to their drivers. Training should focus on the most common causes of accidents, including failing to see smaller vehicles on the road, even those parked on the shoulder. With proper training, truck drivers are better equipped to safely handle the wide variety of road hazards with which they are presented every day. If the trucking company involved in this accident did not facilitate regular training for its drivers, Key’s family would likely have a direct claim against the company for failing to properly train its drivers.

The legal process provides families who lost loved ones in an unexpected crash with a way to recover the financial support they need to deal with their loss. It also holds wrongdoers accountable for their actions with the hope that similar accidents will be prevented. This senseless loss of life cannot go unanswered.
