Mackenzie Pena suffered incapacitating injuries in a collision with a semi-truck in Carrollton

CARROLLTON, Texas—Mackenzie Dee Pena, 31, was severely injured around 9:14 p.m. on September 3, 2022, after crashing into the side of a semi-truck while traveling westbound along Trinity Mills near the President George Bush turnpike.

According to initial reports, Pena was driving on Trinity Mills Road when she approached an 18-wheeler stopped across multiple traffic lanes after merging from the President George bush turnpike. Pena’s vehicle collided with the side of the semi-truck’s trailer.

Pena was transported to a nearby hospital with incapacitating injuries. No other injuries were reported as a result of the accident.

Investigation into the cause of the crash is ongoing. No additional details about the crash were immediately available.

Further investigation will likely reveal the severity of this accident could have been lessened

All drivers have a duty to drive safely on our roadways, including semi-truck drivers. Therefore, even though Pena likely did not see the semi-truck stopped across multiple lanes of traffic, she may not be entirely at fault for this accident.

By coming to rest across more than one lane of traffic, the driver of the semi-truck put himself and others at risk of an accident. After all, basic traffic rules demand that drivers maintain their own singular lane and not cross over solid lines into the lanes of others. Even if the semi-truck was attempting to merge from the President George Bush turnpike, it is well-known that drivers must only attempt to merge one lane at a time and cannot block multiple lanes of traffic.

An independent investigation may be able to determine whether the truck driver had been properly educated on how to maneuver such a large vehicle in heavy traffic. If not, Pena may be able to bring a claim against the truck driver or the company that employed the driver through the doctrine of vicarious liability, which holds larger companies responsible for the negligence of their employees.
