Tammy Berger was killed in a crash with a semi-truck on US 30

ALLEN COUNTY, Indiana—Tammy Berger, 48, passed away on September 2, 2022, in a car crash involving a semi-truck at the intersection of US 30 and Franke Road near Wane, Indiana.

Police reports state that Berger was riding in the front seat of a pickup truck as a passenger when the pickup was struck by a semi-truck crossing the intersection on US 30. Berger and one other individual involved in the accident were taken to a local hospital for medical treatment.

According to the police, Berger later died due to her injuries. A coroner determined Berger’s cause of death to be from multiple blunt force injuries. The status of the other individual has not been released.

The crash is still under investigation. No further information was made immediately available.

Thoughts on fatal truck accidents and potential remedies available to the surviving family

Even though we do not know all the details surrounding this terrible accident, it appears as though the driver of the semi-truck failed to avoid colliding with the pickup in which Berger was riding. An independent investigation into the crash could reveal more information about the cause of the accident and provide important clues as to who may be at fault for this accident.

If the semi-truck driver was crossing at the intersection of US 30 and failed to see the pickup, the semi-truck driver and, possibly, the truck driver’s employer will need to answer to Berger’s family as they seek justice for their loved one.

Arguably more than other drivers on the road, semi-truck drivers must be especially aware of their surroundings. However, if semi-truck drivers become distracted while operating such a large vehicle, there can be serious consequences. In addition to distracted driving, a lack of education can contribute to a semi-truck driver’s failure to see smaller passenger vehicles or avoid a collision.

Commercial trucking companies are responsible for ensuring their hired drivers have the resources necessary for making safe decisions on the road. To facilitate safety, trucking companies can offer training for drivers on evasive driving, blind spots, and stopping distances. Perhaps the semi-truck driver that hit Berger did not receive or have access to these types of training. If that is the case, Berger’s family may have a legal claim against both the semi-truck driver and any trucking company involved in this crash.

To determine whether the semi-truck driver, in this instance, was distracted or failed to avoid the collision with Berger due to a lack of training, an attorney’s independent investigation into the cause of the accident is critical. Berger’s family would also benefit from consulting a lawyer to facilitate further investigation because an attorney could request documentation of training from the company, video or dash cam footage from the semi-truck, and many other pieces of evidence that might not be otherwise available to the family through the police reports. Our firm can provide legal strategies focused on obtaining recovery for injured victims of semi crashes and pursuing various avenues of recovery for surviving family members.
