Eddai Herrera Dies, One Other is Injured in a Rollover Accident in Sherman, Texas

Sherman, TX – One person died, and another sustained injuries in a single-vehicle rollover accident. The incident happened in a Sherman neighborhood on Friday.

According to reports, a truck lost control, rolled over, struck a utility pole, and stopped before colliding with the home.

The driver, identified as 33-year-old Eddai Herrera, was pronounced dead. The passenger sustained injuries but is expected to recover.

No additional details have been released.

Accidents involving a rollover should be investigated to determine if the vehicle was defective

Following a rollover accident, it is important to look beyond what is reported in the news or what is provided by the police. This is because most of the initial investigations into rollover crashes only focus on why the driver failed to maintain control of the vehicle. However, if you think about it, rollover accidents are so common that even when a driver does lose control of the vehicle, they shouldn’t have to die. Our vehicles should be built with enough strength to withstand a rollover crash, and when they aren’t, the fatal injuries suffered in the crash may be the fault of the company that made the vehicle, not the driver of the vehicle.

Another way to think about this is should a person in a BMW survive when, in the same accident, a person in a Ford dies? Should life or death decisions really come down to what brand of vehicle you drive? The law doesn’t think so and requires manufacturers that can protect occupants in rollover crashes.

We have handled hundreds of rollover accident cases for people seriously injured or killed in a rollover accident where the vehicle involved was clearly defective. It happens all the time, and it is by holding manufacturers responsible that safer vehicles are designed and sold.

Based on the information provided, there is no way to know if the vehicle involved in this crash provided sufficient protection to its occupants. However, that is a question that should probably be answered, given a person was killed and another was injured.
