Man Dies in Accident with a Stopped Truck on US 27 in Hialeah Gardens, Florida


Hialeah Gardens, Fl. — A man died in a crash with a tractor-trailer on Sunday morning on US 27, south of NW 138th Street.

According to reports, the driver of a blue Chevy pickup truck was heading north when he collided with a stationary tractor-trailer.

The pickup truck driver died at the scene.

His identity has not yet been released.

Trucks should not park next to moving lanes of traffic

Many might view this crash as an unfortunate event possibly caused by driver error. However, this perspective isn’t entirely fair. We need to ask why the truck was stopped in the first place. Commercial trucks should not use the side of a busy highway as a parking space. Truck drivers know that even a small error by a passing driver can lead to serious injury or death.

The Federal Motor Carrier Safety Administration (FMCSA) has issued guidelines warning against parking on the shoulder because of the significant dangers it presents. The trucking industry acknowledges this risk, as fatalities often occur when trucks park close to moving traffic lanes. Truck drivers who park in dangerous areas should not avoid responsibility by placing blame on the deceased driver: they should have never been stationed there to begin with.

Unfortunately, these types of accidents are happening way too often. I recently handled a case where a young husband and father collided with a semi-truck parked near a lane of moving traffic. The truck driver claimed he had to stop due to a flat tire and blamed the young man for the crash. However, our investigation revealed that the tire had been underinflated for a long time. The trucking company had repeatedly chosen to temporarily inflate the tire instead of replacing it, compromising safety. Although the blown tire seemed like a valid reason to stop, it resulted from a deliberate decision to prioritize profits over safety. This choice led to a man’s death and left a child fatherless.

An investigation is needed to determine the precise details of this crash and why the truck was halted in such a hazardous spot. Should any negligence or wrongdoing be discovered, the surviving family is entitled to justice and compensation.
