Driver Dies in an Accident with a Parked Semi-Truck Near Interstate 285 on South Fulton, Georgia

South Fulton, Ga. – One person has died in a collision with a semi-truck. The incident happened Wednesday morning between Interstate 285 and Buffington Road.

According to reports, a Hyundai was traveling south when it veered off the right side of the roadway and collided with a tractor-trailer parked on the shoulder.

The driver of the Hyundai, whose identity has not yet been released, was pronounced dead at the scene.

No further details have been provided.

Semi-trucks should not use roads as parking spaces

Some might rush to fault the deceased for crashing into the parked truck. But why was a large semi-truck parked alongside a lane where vehicles are in motion? Shouldn’t the truck driver realize that even a slight error by a passing driver could result in severe harm or death? The trucking industry knows this situation has been repeated numerous times and is a recognized danger. Fatalities happen when trucks park next to lanes where traffic moves. Truck drivers who choose to park in such hazardous spots should not escape accountability by blaming the driver who passed away.

Unfortunately, these types of preventable accidents happen far too often. For instance, I recently represented a case where a young husband and father collided with the rear of a semi-truck parked next to a lane of moving traffic. The truck driver claimed he had to stop due to a flat tire. However, our investigation revealed that the tire had been underinflated for a long time. The trucking company had repeatedly chosen to temporarily inflate the tire rather than replace it, compromising safety. This negligence, initially appearing as a justified need to pull over, ultimately stemmed from a deliberate decision to prioritize profits over safety. This choice resulted in a man’s death and left a child without a father.

Because of these dangers, the Federal Motor Carrier Safety Administration (FMCSA) has issued guidelines advising against parking on the shoulder. Truck drivers who park in such dangerous spots should not evade responsibility by attributing all fault to the deceased driver.

This crash needs to be investigated to determine exactly what happened. If any wrongdoing or negligence is discovered, the surviving family should be provided answers.
