Personal Injury Lawyers Have Filed a Lawsuit Against Swift Transportation After Truck Crash

The Ammons Law Firm has filed a lawsuit against Swift Transportation, FC Meyer Packaging, and Model 2 Transport after an 18-wheeler and car collided in Colorado. The plaintiff was the passenger in the car traveling on I-70 in Adams County, Colorado, at the time of the accident.

It was nighttime, so the surrounding area was quite dark. The driver for Model 2 Transport had decided to stop on the interstate, blocking the westbound lanes. The car the plaintiff was in could not have done anything to react to the stopped truck and thus collided with it. As a result of this, the plaintiff suffered serious injuries, including the loss of an arm. 

The plaintiff claims negligence on all defendants, gross negligence for Swift and Model 2 Transport and per se negligence for Model 2 Transport. 

The plaintiff alleges that Model 2 Transport is vicariously liable for the acts of its driver because its driver was acting within the scope of his employment. The suit further alleges that Model 2 Transport is directly negligent in that it did not adequately train or supervise its drivers and failed to enforce company safety rules.

Swift Transportation is allegedly liable for negligence and gross negligence because it had a duty to safely transport and select a qualified motor carrier to ship its freight containers. 

FC Meyer Packaging is allegedly liable for negligence because it also had a duty to exercise reasonable care when it selected and hired a driver and motor carrier. Since it contracted with Swift and Model 2 Transport, it should be held liable for the harm done to the plaintiff. 

The plaintiff seeks several types of damages, including physical pain and disfigurement, mental anguish, loss of earnings capacity, medical care, and costs of court.
