Truck Accident Lawyers File Lawsuit Against Allen Enterprises, LLC After Fatal Kentucky Truck Crash

The Ammons Law Firm has taken legal action against Allen Enterprises, LLC following a tragic tractor-trailer accident that resulted in a fatality. The incident occurred on U.S. Highway 60 W in Union County, Kentucky, when a commercial motor vehicle operated by Allen Enterprises allegedly backed onto the company’s premises, blocking both lanes of traffic.

According to the lawsuit, the tractor-trailer driver employed by Allen Enterprises stopped on U.S. Highway 60 and began backing the vehicle onto the company’s property. During this maneuver, the trailer allegedly obstructed both lanes of the highway. A passenger vehicle traveling eastbound on U.S. Highway 60 collided with the side of the trailer, resulting in fatal injuries to the driver.

The Ammons Law Firm argues that Allen Enterprises acted negligently in several ways. The company allegedly failed to maintain its property to allow tractor-trailers adequate space to turn around after entering the premises. This created a dangerous condition that required trucks to impede traffic when entering. The lawsuit also claims that Allen Enterprises allowed tractor-trailers to back into its premises without proper safety measures, such as spotters or warning systems for oncoming motorists.

The legal action further alleges that Allen Enterprises is vicariously liable for the actions of its employee operating the tractor-trailer. The driver allegedly failed to exercise reasonable care while maneuvering the large commercial vehicle, violating several Kentucky statutes and Federal Motor Carrier Safety Regulations.

In addition to claims of negligence, the lawsuit accuses Allen Enterprises of gross negligence and seeks both compensatory and punitive damages. The Ammons Law Firm argues that the company’s conduct created an unreasonable risk of harm to other motorists on the highway.
