Tire Defect Lawyers File Lawsuit Against Cooper Tire After New Mexico Rollover Accident

The Ammons Law Firm filed a lawsuit against Cooper Tire & Rubber Company following a devastating rollover crash that left a passenger catastrophically injured. The incident occurred when a tire on a Dodge Durango allegedly experienced a sudden tread separation, causing the driver to lose control of the vehicle.

According to the lawsuit, the owner of the Durango had recently purchased and had installed four new tires from H&D Tire Shop. One of these tires was a Cooper Discoverer H/T, which allegedly failed while the vehicle was traveling on U.S. 550 in Sandoval County, New Mexico. The tire failure led to a rollover crash that left a passenger paralyzed.

The Ammons Law Firm is pursuing claims of negligence, gross negligence, and strict liability against Cooper Tire. The lawsuit alleges that Cooper Tire designed, manufactured, and supplied a tire that was defective in its design, manufacture, and warnings. Specific allegations include inadequate component adhesion, use of substandard materials, and failure to incorporate sufficient features to prevent tread separation.

The lawsuit further claims that Cooper Tire failed to properly inspect for defects, ignored past consumer complaints, and did not adequately warn about potential hazards associated with the tire’s age. Ammons Law Firm argues that safer alternative designs existed that could have prevented or reduced the risk of injury without substantially impairing the tire’s utility.

H&D Tire Shop is also named as a defendant in the lawsuit. As the supplier and installer of the allegedly defective tire, H&D Tire Shop faces strict liability claims for selling an unreasonably dangerous product. The lawsuit contends that H&D Tire Shop knew or should have known about the tire’s dangerous condition.
