The Ammons Law Firm has filed a lawsuit against Nissan Motor Co., Ltd., Nissan North America, Inc., and Garff Enterprises, Inc., doing business as Ken Garff West Valley Chrysler Jeep Dodge. The lawsuit stems from a rollover accident involving a Nissan Murano that allegedly resulted in spinal cord injuries to a passenger.
The incident occurred when the Nissan Murano was traveling northbound on the Mountain View Corridor in West Valley City, Utah. The vehicle allegedly hydroplaned, left the roadway, contacted an embankment, and rolled on its side. During the rollover, the roof structure of the Murano, specifically the A-pillar and roof rail on the right front side, allegedly deformed downward and inboard. The sunroof and front windshield shattered as a result of the intrusion.
Despite the passenger allegedly wearing a proper three-point restraint in the right front seat, their head interacted with the Murano’s deforming roof. This interaction resulted in a spinal cord injury, causing permanent paralysis.
The lawsuit claims that the Nissan defendants were negligent in the design, manufacture, and assembly of the Murano’s rollover protection system (ROPS). The ROPS, which consists of the roof support structures, seat belt restraints, side curtain airbag, and vehicle glazing, was allegedly inadequate to protect occupants during a rollover crash.
Specific allegations against Nissan include inadequate roof support structures, insufficient interconnection between pillars to distribute force and energy, and seat belts that allegedly do not lock in a manner preventing lateral and vertical movement of an occupant’s head and body during a rollover.
The lawsuit also alleges that Ken Garff West Valley Dodge was negligent in selling the Murano with allegedly deficient tires and an inadequate ROPS. Furthermore, the dealership is accused of improperly inspecting the tires and failing to disclose known tire and ROPS deficiencies.
