The defendants named in the lawsuit include Premier Millwright Inc., Mid-Iowa Cooperative, Mid-States Millwright & Builders Inc., and Schlagel, Inc. This legal action stems from a horrific incident that resulted in severe injuries to two workers at the facility.
The accident occurred at a grain elevator owned and operated by Mid-Iowa Cooperative. According to the lawsuit, the workers were engaged in the installation of a new ventilation system near a transfer conveyor when tragedy struck. The conveyor, which was allegedly designed and manufactured by Schlagel, Inc., unexpectedly started running while one of the workers was standing on its lid. The protective cover came off, causing the worker to fall into the moving machinery.
In a desperate attempt to save his colleague, the second worker also became entangled in the conveyor’s mechanism. Both men suffered catastrophic injuries, including traumatic amputations of their legs. The lawsuit alleges that the workers were trapped in the equipment for an extended period before they could be rescued by first responders, enduring unimaginable pain and trauma.
The Ammons Law Firm is pursuing claims of negligence against Premier Millwright and Mid-States Millwright & Builders, who were allegedly acting as general contractors on the project. The lawsuit contends that these companies failed to ensure proper safety measures were in place, including adequate lockout/tagout procedures and warnings about the dangers of the conveyor system.
Mid-Iowa Cooperative, as the owner and operator of the facility, is facing premises liability claims. The lawsuit alleges that Mid-Iowa failed to maintain a safe working environment and did not properly warn workers about the hazardous conditions on the premises.
Schlagel, Inc., the alleged manufacturer of the conveyor, is accused of design defects and failure to warn. The lawsuit claims that the conveyor lacked crucial safety features, such as an emergency shut-off system and proper guarding. Additionally, it alleges that Schlagel failed to provide adequate warnings about the potential dangers of the equipment.
The lawsuit seeks compensation for the workers’ extensive injuries, including past and future medical expenses, lost wages, loss of earning capacity, and pain and suffering. The spouses of the injured workers are also claiming damages for loss of consortium due to the life-altering nature of their husbands’ injuries.
