The incident occurred when the woman attempted to refuel the fire pit, believing the flame had gone out. Unknown to her, a nearly invisible flame was still burning. When she poured more alcohol fuel into the pit, it allegedly caused a phenomenon known as “flame jetting” – where flames explosively erupt from the fuel container like a flamethrower. This resulted in severe burn injuries to the woman and caused a house fire.
The lawsuit alleges that Amazon failed in its duty as a product seller to ensure the fire pit was safe and had proper warnings. Specifically, it claims Amazon should have known about the risks of flame jetting with alcohol-fueled fire pits, which have been banned in some countries due to their dangers. The complaint states that Amazon negligently allowed this hazardous product to be sold through its platform without adequate safety precautions or warnings about refueling risks.
Additionally, the lawsuit argues that Amazon should be held to the same liability standards as a manufacturer in this case. This is because the actual manufacturer of the defective fire pit cannot be located or served with legal process, leaving Amazon as the responsible party in the distribution chain.
The case highlights the complexities of product liability in the age of e-commerce, where Amazon’s role serves as the center point of the consumer experience. The lawsuit contends that Amazon’s significant control over the sales process, from listing to delivery, means it bears responsibility for the safety of products sold through its platform.
The woman allegedly suffered catastrophic burn injuries in the incident that left her in a coma for many months. Her husband and children are also named as plaintiffs, seeking damages for loss of consortium and parental consortium due to the life-altering nature of her injuries.
