Ammons Law Firm Files Lawsuit Against Cantu & Sons Trucking after Texas Truck Accident

The Ammons Law Firm has filed a lawsuit against Cantu & Sons Trucking, Inc. in connection with a serious tractor-trailer accident. 

According to the lawsuit, the driver of the Cantu & Sons Trucking tractor-trailer allegedly backed his semi-truck onto the highway, obstructing moving traffic. This action reportedly resulted in a collision with a passenger vehicle traveling northbound on State Highway 107. The occupants of the passenger vehicle suffered serious injuries in the crash.

The lawsuit alleges that the tractor-trailer driver failed to follow proper safety procedures when backing the large vehicle onto a public roadway. Texas commercial driving guidelines strongly advise against backing tractor-trailers whenever possible due to the inherent dangers involved. When backing is necessary, drivers are instructed to use helpers and carefully check their path.

In addition to claims against the individual driver, the lawsuit names Cantu & Sons Trucking as a defendant. The company is alleged to be vicariously liable for the driver’s actions under the legal doctrine of respondeat superior, as the driver was reportedly acting within the scope of his employment at the time of the incident.

The lawsuit also includes claims of independent negligence against Cantu & Sons Trucking. These allegations include failure to properly train and supervise the driver, inadequate safety policies and procedures, and negligent entrustment of the tractor-trailer to the driver involved in the accident.

The legal action seeks damages for the injured parties, including compensation for physical pain, mental anguish, physical impairment, and medical expenses. The lawsuit argues that the defendants’ alleged negligence was the proximate cause of the plaintiffs’ injuries and ongoing suffering.
