The Ammons Law Firm filed a lawsuit against several companies, including Shark Trucking, Inc., Shark Benefits, LLC, CSS Industries, LLC d/b/a Hoffman Truck Services, Hoffman Crescent, LLC, Shark Logistics, LLC, and GH Blackhawk, LP. The lawsuit stems from a tragic incident that allegedly resulted in the wrongful death of a young man at a property in Houston.
According to the lawsuit, the victim was on the premises of a property owned by GH Blackhawk, LP and allegedly operated by the other named defendants. The incident allegedly occurred when the victim was attempting to exit the property. The lawsuit claims that a security guard, who believed he was employed by Shark Benefits, allegedly produced a firearm and shot the victim in the back. The gunshot allegedly pierced the victim’s right lung and carotid artery, ultimately leading to his death.
The Ammons Law Firm is pursuing various legal theories in this case, including negligence, gross negligence, and premises liability. The lawsuit alleges that the defendants failed in their duty of care in several ways. These alleged failures include improper hiring practices, inadequate training and supervision of security personnel, and failure to implement proper safety protocols.
One of the key allegations in the lawsuit is that the defendants allegedly allowed a convicted felon to possess a firearm on the property and entrusted him with security duties. The lawsuit claims that this decision, along with an alleged failure to conduct proper background checks, directly contributed to the tragic outcome.
The lawsuit also raises questions about the corporate structure of the defendants. The Ammons Law Firm is arguing that the separate identities of these companies should be disregarded due to what they allege is a unity of interest and ownership. This legal strategy, known as “piercing the corporate veil,” could potentially hold multiple entities responsible for the alleged negligence.
The victim’s family is seeking damages for loss of companionship, mental anguish, and the suffering endured by the deceased before his death. The lawsuit also seeks exemplary damages based on allegations of gross negligence.
