During the collision, the back of the front passenger seat allegedly contacted the top of the car seat, causing its shell to deform and collapse.
According to the lawsuit, this collapse pushed the infant forward, creating slack in the child’s restraint. This resulted in higher head excursion than would have occurred if the car seat had remained intact. Tragically, the infant’s head allegedly struck the handle of the car seat, causing severe brain injuries.

Specifically, the lawsuit claims that the company did not warn parents that the safest place to install the car seat was in the middle of the second row, where it would not come into contact with front seats during a rear-impact collision.
Furthermore, the lawsuit alleges that Artsana USA, Inc. did not properly test the car seat for safety in rear-impact collisions or in scenarios where a front row seat might collapse onto the car seat. The legal action also claims that the company failed to use safer alternative designs that were economically and technologically feasible at the time of manufacture.
The lawsuit includes claims of strict products liability, negligence, gross negligence, and breach of warranty against Artsana USA, Inc.
