Texas Truck Accident Lawyers File Lawsuit Against Landstar Inway After Fatal Crash

The Ammons Law Firm has filed a lawsuit against several trucking and logistics companies following a deadly crash on Interstate 45 in Walker County, Texas. The defendants named in the suit include Import Automation LLC, Zeon Logistics Inc., Landstar Express America Inc., Landstar Inway Inc., and Realtime Express Inc.

The lawsuit stems from a tragic incident where a commercial truck collided with the rear of a passenger vehicle carrying multiple occupants, including children. Sadly, three people lost their lives in this horrific crash. The commercial vehicle, a Ford F350 hauling a trailer, was allegedly transporting freight for the defendant companies at the time of the collision.

The truck driver allegedly failed to notice a slower-moving Chevrolet Impala that had experienced a flat tire. The driver purportedly did not slow down in time, resulting in a devastating rear-end collision. The lawsuit claims that the defendants’ negligence and failure to properly vet and monitor their drivers contributed to this tragedy.

The Ammons Law Firm is pursuing various legal theories against the defendants. These include negligence, gross negligence, and negligence per se. The lawsuit alleges that the companies failed to adequately investigate, qualify, and monitor the motor carriers and drivers they hired to transport freight. It also claims that the defendants did not have proper safety management controls in place.

One key aspect of the case involves the concept of “broker liability.” The lawsuit contends that the defendant companies had a duty to select safe and qualified motor carriers and drivers. By allegedly failing to do so, they may be held responsible for the tragic outcome.

The legal action also invokes the doctrine of respondeat superior, which holds employers accountable for the actions of their employees while on the job. The lawsuit argues that the truck driver was acting as a statutory employee of several defendant companies at the time of the crash.
