The defendants named in the suit include Goodyear Tire & Rubber Co., Purcell Tire Company, and Western Equipment Co. This legal action stems from a serious crash involving a cement truck that resulted in severe injuries to the driver.
According to the lawsuit, the incident occurred when a Goodyear G296 MSA tire mounted on the left front steer axle of a Western Equipment Co. Kenworth cement truck allegedly failed. The tire’s tread and portions of the belts detached from the casing, causing a blowout and leading to a crash on a highway outside Phoenix, Arizona.
The Ammons Law Firm argues that the tire in question was defective and unreasonably dangerous in its design and manufacture. They allege that Goodyear failed to provide adequate warnings and instructions concerning the tire’s inspection, use, maintenance, and repair. The lawsuit also claims that Goodyear was aware of problems and defects associated with the G296 MSA tire but did not issue a recall.
The legal action extends beyond Goodyear to include Purcell Tire Company and Western Equipment Co. The suit alleges that these companies, along with their employees, undertook tire inspection services on the truck but failed to detect the alleged defects in the tire. The lawsuit contends that these inspections were negligently performed and that the companies should have recognized the importance of these services for the safety of the truck’s drivers.
The incident resulted in severe injuries to the truck driver, including a traumatic brain injury, facial trauma requiring skin grafts, hearing loss, and injuries to both shoulders requiring surgeries. The driver is now reportedly 100% occupationally disabled due to these injuries.
