Truck Accident Lawyers File Lawsuit Against Fleet Management Logistics and Cowan Intermodal Group in Fatal Semi-Truck Accident

The Ammons Law Firm has taken legal action against Fleet Management Logistics LLC and Cowan Intermodal Group LLC following a tragic commercial truck accident that resulted in a fatality. The incident occurred on FM 546 in Collin County, Texas, when a tractor-trailer allegedly crossed into oncoming traffic and collided with a passenger vehicle.

According to the lawsuit, the driver of the tractor-trailer was allegedly operating the vehicle at an unsafe speed as it approached a curve in the road. The trailer being towed was reportedly overloaded, which may have contributed to the truck’s loss of control. As a result, the tractor-trailer rolled over into the northbound lane, with the trailer landing on top of the passenger vehicle.

The Ammons Law Firm is pursuing multiple causes of action against the defendants. The lawsuit alleges that Fleet Management Logistics LLC and Cowan Intermodal Group LLC are vicariously liable for the actions of their driver under the doctrine of respondeat superior. This legal principle holds employers responsible for the negligent acts of their employees when those acts occur within the scope of employment.

In addition to vicarious liability, the lawsuit claims that both companies were independently negligent in their hiring, training, and supervision practices. The Ammons Law Firm argues that the defendants failed to properly train the driver on safe driving practices and the safe operation of the tractor-trailer. The lawsuit also alleges negligent entrustment, claiming that the companies should not have allowed the driver to operate the vehicle.

Commercial Vehicle Enforcement Troopers reportedly found that three of the trailer’s brakes were defective at the time of the crash. The lawsuit also claims that the defendants were negligent in the loading of the trailer, either by directly loading it in a dangerous manner or by authorizing the cargo to be loaded in a way that allowed it to shift during transit.

The lawsuit seeks to hold the defendants accountable for their alleged negligence and to obtain justice for the victim’s family.
