In addition to claims of negligence against the truck driver, the lawsuit alleges that National Trucking is vicariously liable for the actions of its employee under the doctrine of respondeat superior. The Ammons Law Firm is also pursuing claims of direct negligence against National Trucking, including negligent hiring, supervision, training, and retention of the driver.
The lawsuit further alleges that National Trucking’s actions constitute gross negligence, claiming that the company acted with flagrant disregard for the rights of others and with actual awareness that their acts and omissions would likely result in serious injury or property damage. As a result, the Ammons Law Firm is seeking exemplary damages against National Trucking to deter future willful and malicious conduct.
The victim in this case allegedly suffered substantial injuries, including physical pain, mental anguish, physical impairment, and disfigurement. The lawsuit seeks compensation for these damages, as well as past and future medical expenses, loss of earning capacity, and other related costs.
