The Ammons Law Firm has filed a lawsuit against Dorel Juvenile Group, Inc., following a serious crash that resulted in catastrophic injuries to a child. The case centers on allegations of defective design and inadequate safety features in a COSCO Apt 50 convertible child safety seat.
According to the lawsuit, a two-year-old child was secured in a forward-facing COSCO car seat when the vehicle they were traveling in was involved in a side-impact collision at the intersection of Hollister Street and N. Sam Houston Parkway West in Harris County, Texas. The crash occurred when a 2019 Jeep Grand Cherokee collided with the passenger side of the vehicle carrying the child. The child suffered catastrophic brain injuries and was transported to Texas Children’s Hospital.
The Ammons Law Firm alleges that the Dorel-manufactured child safety seat was defectively designed for side-impact collisions and failed to provide adequate crash protection. The lawsuit claims Dorel allegedly failed to include sufficient protection for a child’s head during foreseeable side-impact collisions despite marketing the seat as having “side impact protection” features.
The lawsuit further alleges that Dorel knew of safer alternative designs but chose not to incorporate them into this model. According to the filing, Dorel allegedly failed to provide adequate warnings about the seat’s limitations in side-impact crashes and proper installation methods regarding forward-facing versus rear-facing positions.
The case includes claims for strict product liability, negligence, negligent undertaking, and breach of warranty against Dorel. The lawsuit alleges that Dorel’s actions constitute gross negligence, arguing the company allegedly proceeded with conscious indifference to safety despite awareness of risks.
