Under the doctrine of respondeat superior, the company is vicariously liable for its driver’s actions as they occurred within the scope of employment. The lawsuit also includes claims of direct negligence against Mansfield Service Partners South for allegedly failing to properly train and supervise the driver.

The complaint further alleges that Mansfield Service Partners South failed to provide adequate training on essential safety procedures like proper visual searches and safe lane changes. The lawsuit claims the company’s deficient supervision enabled unsafe driving practices that allegedly contributed to the collision.

Additional claims include negligent entrustment and hiring, with allegations that Mansfield Service Partners South knew or should have known the driver was unqualified to operate a commercial truck safely. The lawsuit argues that proper screening would have revealed the driver’s alleged lack of basic commercial driving skills.
