The Ammons Law Firm has filed a lawsuit against The Truesdell Corporation and others following a tragic accident that resulted in a fatality on State Highway 105 in Liberty County, Texas.

According to court documents, a Truesdell Corporation driver was operating a 2011 Chevrolet Silverado pulling a 2021 Loadcraft trailer westbound through a construction zone when the incident occurred. The driver allegedly allowed the trailer’s wheels to cross over the center stripe reflectors into oncoming traffic. The trailer collided with an eastbound vehicle, causing the trailer’s left rear wheel to become airborne. The dislodged wheel crashed through the windshield of another eastbound vehicle, resulting in fatal injuries to its driver.

The lawsuit alleges that Truesdell Corporation and Truesdell Corporation of Wisconsin failed to properly train and supervise their driver. The complaint claims the companies allegedly did not use common forms of driver monitoring that responsible fleet owners routinely follow. The lawsuit further alleges that Truesdell’s training and oversight protocols did not equip their driver to avoid this preventable incident and did not encompass materials and practices that are standard in the industry.

The legal action raises several theories of liability, including respondeat superior, which holds employers responsible for employees’ actions within the scope of employment. The lawsuit also includes claims of negligent entrustment regarding the companies’ decision to allow their driver to operate the commercial vehicle.
