The Ammons Law Firm has filed a lawsuit against Herian Brothers Trucking, Inc. and others following a catastrophic highway collision that resulted in severe injuries. The incident occurred on Interstate 10 in Reeves County, Texas.

According to the lawsuit, the driver of a Herian Brothers Trucking tractor-trailer allegedly collided with a vehicle traveling eastbound on I-10. The impact allegedly sent the victim’s vehicle rolling off the roadway, resulting in the driver suffering life-threatening injuries.

The lawsuit contends that the Herian Brothers Trucking driver failed to maintain a safe following distance, was traveling at an unsafe speed, and failed to take proper evasive action to avoid the collision. These actions allegedly demonstrated negligence in the operation of a commercial vehicle.

The lawsuit seeks to hold Herian Brothers Trucking vicariously liable under the doctrine of respondeat superior, as the driver was allegedly acting within the scope of employment at the time of the crash. The lawsuit also includes claims of independent negligence against the trucking company for allegedly failing to properly train and supervise its driver.

The lawsuit also alleges gross negligence against the driver and Herian Brothers Trucking. The lawsuit claims Herian Brothers Trucking’s actions showed conscious indifference to the rights, safety, and welfare of others on the roadway.

The victim allegedly suffered multiple severe injuries requiring emergency medical transport and hospitalization. The lawsuit seeks compensation for physical pain, mental anguish, medical expenses, loss of earning capacity, physical impairment, and other damages.
