Specifically, the complaint claims the companies failed to remove accumulated leaves, repair loose and broken pavers, and provide adequate warnings about these hazardous conditions.
As a paying hotel guest, the injured party was considered an invitee under the law, which means the hotel owed her a high duty of care. This includes discovering dangerous conditions and either fixing them or warning guests about potential hazards. The lawsuit argues that the defendants knew or should have known about the dangerous conditions but failed to take reasonable steps to protect their guests.

The victim continues to suffer physical pain and mental anguish from the incident and seeks compensation for various damages, including medical expenses, loss of enjoyment of life, lost income and earning capacity, and other personal injury damages allowed under New Mexico law.
