One Person Killed in Accident After Semi-Truck Strikes Disabled Vehicle on U.S. 31 Near 256th St. in Hamilton County, Indiana

HAMILTON COUNTY, Ind. —  One person died after being struck by a semi-truck on southbound U.S. 31 on Thursday morning. The incident happened near 256th Street, roughly eight miles north of downtown Westfield.

According to reports, a Kia Optima struck a deer while traveling southbound, then veered off the roadway and down an embankment before returning to the highway in a disabled condition.

According to Sgt. Bryan Melton, the driver, is believed to have exited the vehicle after it came to a stop. A southbound semi-truck then hit both the disabled car and the driver.

The driver of the Optima was pronounced dead at the scene.

Seeking Answers After a Semi-Truck Hits a Driver in an Emergency

What a tragedy. The Kia became disabled and came to rest in the roadway — an emergency that can happen to anyone. Drivers are allowed to exit a disabled vehicle if they believe it’s unsafe to remain inside. They did what many of us would do in the exact moment.

Semi-truck drivers have a duty to maintain control, keep a proper lookout, and adjust their speed to roadway conditions. Even in the early morning hours, commercial drivers must anticipate hazards and be prepared to avoid a stopped vehicle. That responsibility doesn’t disappear because visibility is low or traffic is light. It becomes even more important.

The key question now is simple: Was the truck driver keeping the lookout required to maintain an assured clear distance ahead?

A full investigation can determine what the truck driver saw, when they saw it, and whether they had enough time to react. Evidence such as skid marks, lighting conditions, dash-cam footage, and data from the truck’s onboard systems can help determine whether this collision was avoidable and where responsibility lies.

When a driver is struck while dealing with an emergency, the family left behind deserves clear answers. They deserve to know whether this crash could have been prevented and whether the truck driver met the basic safety duties required of every commercial operator on the road.

Our hope is that the surviving family finds the answers they need.
