The Ammons Law Firm has filed a lawsuit against Crete Carrier Corporation and its driver concerning a serious tractor-trailer accident on Interstate Highway 44. The lawsuit alleges that negligent driving practices led to a collision that caused significant injuries.
According to the lawsuit, the driver of the Crete Carrier Corporation tractor-trailer allegedly failed to slow down despite rainy weather conditions and struck another tractor-trailer from behind. The collision allegedly occurred when the driver followed too closely and failed to adjust his speed for the weather and traffic conditions on the highway.
The legal action claims that Crete Carrier Corporation is vicariously liable for their driver’s actions under the legal doctrine of respondeat superior, as the driver was reportedly acting within the scope of his employment at the time of the incident.
The lawsuit also includes claims of independent negligence against Crete Carrier Corporation. These allegations include failure to properly train and supervise the driver, inadequate safety policies and procedures, and negligent entrustment of the tractor-trailer to the driver involved in the accident.
The crash investigation found that the driver was “following too closely for weather and traffic conditions” and was cited for following too closely. The lawsuit alleges that no improper conduct by the other driver caused or contributed to the collision.
The injured victim reportedly suffered serious injuries to the neck, back, and hip as a result of the crash. The lawsuit seeks compensation for physical pain, mental anguish, physical impairment, and medical expenses.
In addition to negligence claims, the lawsuit also alleges gross negligence against both defendants. The legal action claims that their conduct demonstrated a reckless disregard for the rights of others and a lack of even slight care and diligence.
The lawsuit argues that the defendants’ alleged negligence was the direct and proximate cause of the victim’s injuries and ongoing suffering. It also claims that Crete Carrier Corporation failed to follow industry standards and best practices that would have prevented such injuries.
