The petition alleges the crash occurred because the truck was operating with a defective tire that failed, and The Ammons Law Firm is seeking to hold Roadjet Transportation and Polestar Transport accountable for negligently operating a commercial vehicle with unsafe tires and for their joint venture relationship, which makes both companies equally liable for failures in maintaining safe equipment. The lawsuit also pursues claims against the New Mexico Department of Transportation for negligent highway maintenance, arguing that NMDOT knew or should have known about the significant risk of cross-over collisions on this stretch of I-40 and failed to install proper safety barriers despite the 75-mile-per-hour speed limit and the prevalence of cross-over accidents throughout New Mexico.
The lawsuit seeks substantial damages on behalf of the surviving family members, including compensation for the conscious pain and suffering experienced by the victims before death, loss of life expectancy, lost income and earning capacity, funeral and burial expenses, and loss of consortium. The plaintiffs are also seeking pre-judgment and post-judgment interest as provided by law.
