It alleges that ACTS Oilfield Services was negligent in entrusting its commercial vehicle to an incompetent and unsafe driver, arguing that the company failed in its fundamental duty to ensure that only properly trained and qualified drivers operate their fleet of commercial vehicles. Furthermore, the personal injury lawsuit claims that ACTS Oilfield Services bears direct responsibility through negligent hiring, training, and supervision practices, contending that the company failed to adequately train its driver on safe driving practices and did not properly enforce company safety protocols — failures that contributed to the fatal outcome.
The plaintiff is also pursuing claims against the driver of the ACTS vehicle for failing to stop or avoid the collision and for operating the commercial truck while allegedly not physically, medically, or emotionally fit to do so. Additionally, the lawsuit names the driver of the stopped vehicle, alleging that he created a dangerous road hazard by stopping in a location where vehicles travel at highway speeds, blocking the roadway, and failing to warn approaching drivers of the hazard.
The wrongful death lawsuit is brought by the victim’s mother, who seeks to recover damages for grief, mental anguish, pain and suffering, and the loss of affection, companionship, counsel, guidance, love, and society. The complaint seeks compensatory damages and pre-judgment and post-judgment interest.
