Truck Accident Attorneys File Lawsuit Against FJ Transport and Others After Fatal Truck Crash

The Ammons Law Firm has filed a lawsuit against FJ Transport, LLC, Cifuentes Truck & Trailer Sales, LLC, and other defendants following a fatal trucking accident in Nolan County, Texas.

According to the lawsuit, a commercial tractor-trailer operated by a driver employed by FJ Transport and/or Cifuentes Truck & Trailer Sales crashed into a RAM 2500 pickup truck. The impact caused the RAM 2500 to roll onto its top, resulting in fatal injuries to one of the occupants.

The lawsuit alleges the driver was traveling at an unsafe speed while towing three trailers at dusk. It further claims that the driver became distracted and failed to pay attention to potential hazards and traffic ahead of the semi-truck before colliding with the pickup truck.

The legal action includes multiple claims against the corporate defendants. The truck accident lawyers at The Ammons Law Firm allege that FJ Transport and Cifuentes Truck & Trailer Sales are vicariously liable for the driver’s actions under the doctrine of respondeat superior, as he was allegedly acting within the scope of his employment at the time of the collision.

According to court documents, the companies allegedly knew or should have known that the driver was unlicensed, unqualified, and incompetent to drive a commercial truck. The lawsuit states that the driver allegedly operated the commercial motor vehicle without a commercial driver’s license, logs, or adequate training.

The lawsuit seeks damages for wrongful death, including compensation for pecuniary loss, loss of companionship and society, and mental anguish suffered by the victim’s family members. The legal action also includes claims of gross negligence against all defendants, which could allow for exemplary or punitive damages.
