The Ammons Law Firm has filed a lawsuit against Porsche Cars North America and others following a tragic single-vehicle crash that allegedly resulted from both driver error and vehicle defects. The incident occurred on RM-1888 near Green Kingdom Road in Kendall County, Texas.
According to the lawsuit, a 2022 Porsche 911 Carrera allegedly went out of control, rolled multiple times, crashed through a fence, and came to rest on its roof. The Texas Department of Public Safety investigation allegedly found failure to maintain a single lane as the primary contributing factor. Porsche’s Electronic Data Recorder allegedly showed the vehicle was traveling at approximately 100 mph in the moments before the crash.
The auto defect lawyers at The Ammons Law Firm allege that the Porsche 911 Carrera had critical safety defects, including the lack of adequate lane-keeping assist and lane departure warning systems that were readily available when the vehicle was manufactured. The complaint argues these defects made the vehicle more prone to loss of control in foreseeable circumstances.
The legal action seeks to hold Porsche Cars North America accountable under theories of strict liability and negligence. The lawsuit alleges the company failed to properly design, manufacture, test, and equip the vehicle with available safety technology that could have prevented the crash. The lawsuit further contends that Porsche knew or should have known about these dangerous defects and failed to address them before placing the vehicle in the hands of consumers.
According to court documents, safer alternative designs were available that would have either prevented these defects or significantly reduced the risk of injury without substantially impairing the vehicle’s utility. The lawsuit relies in part on the Malfunction Doctrine set forth in the Restatement (Third) of Torts: Products Liability.
