Tire Defect Lawyer Resolves Wrongful Death Lawsuit After Fatal Truck Crash

The personal injury attorneys at The Ammons Law Firm resolved a wrongful death case brought on behalf of a family who lost a husband and father in a trucking crash.

Our client was driving a commercial truck on the highway when one of the front steer axle tires failed. The tread came apart while the tire was in normal service, at highway speed, with no warning. Once the tread let go, the driver lost control. The truck left the roadway and rolled. Our client did not survive.

Tires are not supposed to come apart. A tire is designed to wear out, not to fail structurally while it still has useful tread left on it. When a tire loses its tread at highway speed, the tire and cause of the crash must be investigated to determine what caused it to fail.

We retained tire failure analysis experts who examined the construction of the tire and identified alleged defects in the materials and the bonding between internal components. We also looked closely at the business that had installed the tire, since a service provider has its own duty to make sure the tires it puts into service are fit to be on the road.

We pursued claims against the tire manufacturer for strict product liability, negligence, and breach of warranty, and against the installer for negligence. We alleged that the tire was defectively designed and manufactured, that the manufacturer failed to warn of known risks, and that the installer failed to catch a tire that should never have been placed into service.

We secured a settlement for the family to help them move forward after this loss.
