Michelin to Pay in Fatal Tire Detread Case

Resolution has been reached in a lawsuit filed by The Ammons Law Firm against Michelin on behalf of a young girl who lost her father in a tragic collision. The crash was triggered by the tread separation of a Michelin LTX M/S2 tire that resulted in a driver’s loss of control of his F350, causing the driver to cross the interstate’s center line and collide head on with the man’s 4Runner.

Allegations in the lawsuit focused on the tire’s defective design and manufacture. Attorney Robert Ammons alleged that the tire showed evidence of poor bonding of the rubber used in the failed tire and that moisture was likely introduced into the components being assembled which prevented effective curing of the tire.

The tire also lacked a feature that improves durability and acts as a countermeasure to tread separations called a nylon cap ply, which Michelin has incorporated into other tires under the BFGoodrich and Uniroyal brands, and even into other Michelin LTX tires.

In this devastating crash, a teenager lost her father, after losing her mother just eight years prior. The compensation being provided to the man’s daughter is in response to her claims for the loss of his love, affection, companionship, care, protection and guidance he provided, and for the severe physical, mental, and emotional distress she has suffered and will continue to suffer as a result of his death.
