Frequently Asked Questions about New Mexico Workplace Accident Injuries
How long do I have to report a workplace injury in New Mexico?
New Mexico law requires written notice to your employer within 15 days of when you knew, or should have known, the injury was work-related, extended to 60 days if you were physically unable to report sooner. Separately, there’s generally a one-year deadline to file the actual workers’ compensation claim, though that period pauses while you remain employed by the same employer. These are two different deadlines, and missing either one can bar your claim, so it’s worth confirming both rather than assuming one covers the other.
Can my employer fire me for filing a workers’ compensation claim?
No. Under NMSA § 52-1-28.2, it’s illegal for a New Mexico employer to fire, threaten, or otherwise retaliate against a worker for seeking workers’ compensation benefits, and violations carry a civil penalty. New Mexico courts have also ordered employers to rehire workers who were fired in retaliation for filing a claim.
I’m an independent contractor, not a direct employee. Does workers’ compensation still apply to me?
It depends on the actual working relationship, not just the label on your paperwork. New Mexico courts look at who controlled the work and how it was structured, and a company can sometimes be treated as a “statutory employer” even over workers it labeled as contractors. This is common on oil and gas sites and construction projects where multiple companies bring in their own crews, and it’s exactly the kind of fact-specific question worth having an attorney sort out early.
Can I receive workers’ compensation and also pursue a claim against another company for the same accident?
Often, yes. Workers’ compensation and a third-party negligence claim aren’t mutually exclusive. If a company other than your employer, an equipment manufacturer, a subcontractor, or another party contributed to your injury, you may be able to pursue a claim against them separately, though New Mexico law does allow the workers’ compensation insurer to seek reimbursement from that third-party recovery in some circumstances. How that plays out depends on the specifics of the case.
Will OSHA investigate my workplace accident?
New Mexico runs its own OSHA-approved State Plan, covering both private-sector and public-sector workplaces, one of only 22 states with that broader coverage. Whether the New Mexico Occupational Health and Safety Bureau investigates a specific incident depends on its severity and other factors, but a safety investigation, when one happens, can produce records and findings that are useful evidence in a related injury or wrongful death claim.
